    Description:

     

     Formal Opinion No. 2015-193 of the Standing Committee On Professional Responsibility and Conduct of the California State Bar (“Committee Opinion”) opines that an attorney may violate ethical duties of competence by failing to understand and perform e-discovery skills. The Committee Opinion set out a list of nine e-discovery tasks that “attorneys handling e-discovery should be able to perform (either by themselves or in association with competent counsel or expert consultants).”

     

     

    The nine skills from the Committee Opinion are:

    1.       Initially assess e-discovery needs and issues, if any;

    2.       Implement/cause to implement appropriate ESI preservation procedures;

    3.       Analyze and understand a client’s ESI systems and storage;

    4.       Advise the client on available options for collection and preservation of ESI;

    5.       Identify custodians of potentially relevant ESI;

    6.       Engage in competent and meaningful meet and confer with opposing counsel concerning an e-discovery plan;

    7.       Perform data searches;

    8.       Collect responsive ESI in a manner that preserves the integrity of the ESI; and

    9.       Produce responsive non-privileged ESI in a recognized and appropriate manner.

     

    Performing many of these skills competently requires understanding mobile device discovery

     

    Mobile devices have become globally ubiquitous, both for personal and professional use.  Increasingly, organizations need

     to consider their mobile device and application use when executing internal investigations and responding to Discovery requests.  

     

     This webinar will address the following questions counsel should ask when considering mobile devices in discovery:

    •       What types of devices are within scope? 

    •       What data sources from those devices are within scope? 

    •       Where are the data located?

    •       How can the data be collected and what are some challenges?

    •       Issues that arise in cross-border matters?

    •       Are corporate policies and or systems in place?

    •       After collection, how is the mobile device data handled for eDiscovery review and production?

    Kathleen McConnell  

    Kathleen McConnell is senior counsel in the San Francisco office of Seyfarth Shaw LLP.  Her practice focuses on issues associated with electronic discovery, information governance, and data privacy.  She regularly assists clients by developing cost-effective strategies for the preservation, collection, review, and production of electronically stored information, including for cross-border matters.  She has also advised clients on record retention and information management.

     

    Mark Michels, Moderator

     

    Director, Deloitte Transactions and Business Analytics, LLP, assists clients with managing complex litigation and ediscovery matters.  Before joining Deloitte he spent 11 years at Cisco Systems where he focused on litigation management and electronic discovery.  Prior to joining Cisco, Mark was an attorney at McKenna and Cuneo where he supervised fraud subpoena responses; conducted multiple internal investigations; performed government contract, regulatory compliance reviews; and prepared responses to government investigations.  Mark is a graduate of the Georgetown University Law Center.

    California State Bar Guidelines require 12 hours of Juvenile Training before representing a minor in juvenile court.  Part 1, of the Criminal Law Section Series on Juvenile Practice, will explain what to expect when handling a case in juvenile court; how juvenile court differs from adult criminal court; and the specific language/codes/procedures used. What every lawyer who represents minors in juvenile court should know.

    Mark Wynn

    Mark Wynn is a senior trial attorney for the Los Angeles County Alternate Public Defender’s Office. He graduated from UC San Diego in 1993 and California Western Law School in 1996.  After graduation, he worked legal affairs in the entertainment field, including MGM and Paramount Studios. In 2000, he became a Deputy Public Defender in Los Angeles. As a public defender, he tried numerous cases from misdemeanors to felonies, including death penalty cases.  He currently represents children in delinquency matters at the Inglewood Juvenile Court.  He has lectured on jury selection in capital cases at the PD/APD Capital Case Seminar and to law students at UCLA Law School.  He has volunteered as a coach and judge with the Constitutional Rights Foundation Mock Trial and as a judge for the NBTA Tournament of Champions Law School Mock Trial.

     

    Maureen Pacheco, Moderator

    Maureen Pacheco is the Trainer for the Juvenile Division of the Alternate Public Defenders Office in Los Angeles and handles the office’s juvenile life without parole resentencing cases.  After graduation from Georgetown Law School in 1986, she became a public defender. From 2010-2013, Maureen was the Assistant Director at Loyola Law School’s Center for Juvenile Law and Policy, where she cofounded and taught the Juvenile Innocence and Fair Sentencing Clinic. She is the cofounder of the Pacific Juvenile Defender Center’s Amicus group and is the juvenile legislative liaison for the California Public Defenders Association. She authored the first bill in the nation to provide for the automatic sealing of juvenile records and has testified as a juvenile law expert before various committees of the California Legislature. Maureen serves on the Advisory Board for the Pacific Juvenile Defender Center, is Chair of the National Association of Criminal Defense Lawyers’ Juvenile Justice Committee, and co-author of Guidelines for Los Angeles Delinquency Practitioners.  She was awarded the Juvenile Defender of the Year in 2015 by the Pacific Juvenile Defender Center and was honored as 2017 Criminal Defense Attorney of the Year by the Los Angeles County Bar Association.

    Litigating trade dress claims can present some challenging pleading and proof issues.  Court decisions on pleading standards and the proof required to prevail at the summary judgment or trial levels have gaps and leave open questions that can impact how you need to plead or prove your cause of action. This presentation will review some of the difficulties you can face when pleading your trade dress claim and address different strategies to prove your trade dress allegations.

     Jeff Lindgren is an IP and business attorney. Jeff represents a wide range of companies, from venture backed start-ups to large publicly traded technology companies, on all types of intellectual property matters, including IP licensing and contracts, trademark and copyright prosecution, IP-related transactions, general IP counseling, and patent, copyright, trademark, trade secret, technology and business litigation matters. He also provides clients with strategic advice and assistance on many day-to-day business matters. Prior to founding Vasquez Benisek & Lindgren LLP, Jeff worked at Cooley Godward LLP and Morgan Miller Blair, where his practice focused in intellectual property, corporate and white collar crime matters. While at Cooley Godward, Jeff served a 3-month stint in the Alameda County District Attorney’s office as part of the firm’s pro bono DA program.

    Cynthia E. Tobisman has won the 2018 Harper Lee Prize for Legal Fiction for her second published novel, Proof.

     

    “I am honored, humbled, and frankly, totally stunned,” Tobisman said in a press release. “The spirit of To Kill A Mockingbird is the spirit of one person’s ability to make the world a little more fair. That the selection committee saw that spirit in my book is something that I will treasure forever.”

     

    Tobisman is a partner with Greines, Martin, Stein & Richland in San Francisco, where she practices appellate law. Under the name C. E. Tobisman, she has published two novels, Doubt and Proof, and a comic book series, Inside the Loop.

     

    Harper Lee Prize logo

     

    The Harper Lee Prize is awarded by the ABA Journal and the University of Alabama School of Law each year to a novel-length work of fiction that best that best illuminates the role of lawyers in society and their power to effect change. Proof is the second book to feature young lawyer Caroline Auden, who is drawn into high-level local government intrigue when she looks into a potential elder abuse case involving her late grandmother. The two other nominees this year were Lisa Scottoline for her book Exposed and Scott Turow for Testimony.

     

    Proof best captures the spirit of iconic characters, role of the legal profession in addressing social issues, and the concluding legal monologue of To Kill A Mockingbird and Go Set A Watchman,” said Dr. Hilary Green, an assistant professor of history at the University of Alabama, and one of the four judges who selected the winning novel. “Caroline Auden is the perfect cross between lawyer Atticus Finch and the grown-up Scout.”

     

    Jini Koh, an attorney and University of Alabama School of Law alum; Tony Mauro, U.S. Supreme Court correspondent for Law.com and the National Law Journal; and Dr. Sena Jeter Naslund, author, co-founder and former program director of the Spalding University MFA in Writing were the other judges. The results of a public poll, in which Exposed placed first and Proof placed second, were used as a fifth vote.

     

    “It’s exciting see to this award go a practicing attorney who’s relatively new to the fiction scene,” says Molly McDonough, editor and publisher of the ABA Journal. “We also love seeing attention being drawn to the important field of elder law. We look forward to seeing what Cindy Tobisman will bring to the genre of legal fiction.”

     

    The Harper Lee Prize will be presented to Tobisman in a ceremony Aug. 30 at the Library of Congress in Washington, D.C., to coincide with the National Book Festival. She will receive a copy of To Kill a Mockingbird signed by Harper Lee, who approved the creation of the award in 2010 to mark the 50th anniversary of her famous novel.

     

    Past authors of Harper Lee Prize-winning books include John Grisham (in 2011 and 2014), Michael Connelly, Paul Goldstein, Deborah Johnson, Attica Locke and James Grippando.

A turn-of-the-century masterpiece with vintage Edwardian décor and architecture as well as luxury accommodations, the Hotel Majestic is one of the premier hotels in San Francisco, California.
