Litigating trade dress claims can present some challenging pleading and proof issues.  Court decisions on pleading standards and the proof required to prevail at the summary judgment or trial levels have gaps and leave open questions that can impact how you need to plead or prove your cause of action. This presentation will review some of the difficulties you can face when pleading your trade dress claim and address different strategies to prove your trade dress allegations.

 

Biography

 

 Jeff Lindgren is an IP and business attorney. Jeff represents a wide range of companies, from venture backed start-ups to large publicly traded technology companies, on all types of intellectual property matters, including IP licensing and contracts, trademark and copyright prosecution, IP-related transactions, general IP counseling, and patent, copyright, trademark, trade secret, technology and business litigation matters. He also provides clients with strategic advice and assistance on many day-to-day business matters. Prior to founding Vasquez Benisek & Lindgren LLP, Jeff worked at Cooley Godward LLP and Morgan Miller Blair, where his practice focused in intellectual property, corporate and white collar crime matters. While at Cooley Godward, Jeff served a 3-month stint in the Alameda County District Attorney’s office as part of the firm’s pro bono DA program.
