    Counterfeiters have been profiting off of copy-cat goods for centuries. Even with the development of advanced enforcement technologies, businesses and consumers continue to be plagued by counterfeit goods. Today, many counterfeit goods are sold through online marketplaces, often without the knowledge of either the online marketplace or the consumer purchasing the goods. Lawyers must be creative yet practical in providing advice for clients facing trademark infringement and counterfeit issues. Join us for a panel discussion about the practical and legal challenges of policing sales of counterfeit goods in major online retail marketplaces and effective strategies for brand and consumer protection. We will hear from outside and in-house counsel to discuss the problems the industry faces, what enforcement strategies are most effective, and who should carry the burden of ensuring that brand owners and consumers are protected from counterfeit goods

    Smartphones, such as iPhones and Android phones, have become ubiquitous in daily life, and can store unique evidence potentially relevant to civil lawsuits of all types. This MCLE will educate students as to the important categories of evidence that can be recovered from smartphones and how these categories can be leveraged in not only a defensive manner but also an offensive manner in civil litigation. Finally, the MCLE will provide reasonable steps one should take to protect attorney-client communications from spying and techniques that can be
    applied to unmask an anonymous unfriendly party.

    California State Bar Guidelines require 12 hours of Juvenile Training before representing a minor in juvenile court.  Part 3, of the Criminal Law Section Series on Juvenile Practice, will teach you the different dispositions available to minors in juvenile courts from diversion to youth authority; how to reach the best disposition for your client, what options you have post disposition, and your responsibilities with juveniles tried in adult court.

    Maureen Pacheco, Moderator

    Maureen Pacheco is the Trainer for the Juvenile Division of the Alternate Public Defenders Office in Los Angeles and handles the office’s juvenile life without parole resentencing cases.  After graduation from Georgetown Law School in 1986, she became a public defender. From 2010-2013, Maureen was the Assistant Director at Loyola Law School’s Center for Juvenile Law and Policy, where she cofounded and taught the Juvenile Innocence and Fair Sentencing Clinic. She is the cofounder of the Pacific Juvenile Defender Center’s Amicus group and is the juvenile legislative liaison for the California Public Defenders Association. She authored the first bill in the nation to provide for the automatic sealing of juvenile records and has testified as a juvenile law expert before various committees of the California Legislature. Maureen serves on the Advisory Board for the Pacific Juvenile Defender Center, is Chair of the National Association of Criminal Defense Lawyers’ Juvenile Justice Committee, and co-author of Guidelines for Los Angeles Delinquency Practitioners.  She was awarded the Juvenile Defender of the Year in 2015 by the Pacific Juvenile Defender Center and was honored as 2017 Criminal Defense Attorney of the Year by the Los Angeles County Bar Association.

     

    Jessica Melikian

    Jessica Melikian is a Deputy Alternate Public Defender for the Los Angeles County Alternate Public Defender’s Office. She attended Loyola Law School where she spent one year representing clients in juvenile court as a certified law student in Loyola’s Juvenile Justice Clinic at the Center for Juvenile Law and Policy. She graduated law school in 2010 and became a Deputy Public Defender. She currently represents children in delinquency matters at the Inglewood Juvenile Court and previously represented adult clients in misdemeanor and felony cases. She has provided training to attorneys in her office and is a volunteer instructor with the Long Beach Bar Association’s Shortstop Program and LA County Teen Court.

    Kristen J. Nesbit 

    Kristen Nesbit is a partner in Fisher Phillips’ Los Angeles office where she practices employment litigation and client counseling.  
    Kristen represents employers from case inception through trial or arbitration. She has represented organizations in multiple jury trials that have resulted in defense verdicts for her clients. Most recently, Kristen served as co-trial counsel in the case Jose Lomeli and Richard McAllister v. Arrow Truck Sales, Inc., Volvo Group North America, Inc, Jody Johnson and Brent Stout,
     where she obtained a complete defense verdict after a 12 day jury trial in downtown Los Angeles, California. At trial, two former managers alleged harassment and discrimination based on race/color, national origin, religion and age along with retaliation for opposing such harassment and discrimination against the defendants.   
    Kristen prides herself in serving as a trusted adviser and strategic partner for her clients. In this vein, she counsels clients regarding a variety of labor and employment issues including the Worker Adjustment and Retraining Notification Act (WARN), Family and Medical Leave Act (FMLA), interactive process and reasonable accommodations, talent management and performance, workplace investigations, and wage/hour compliance.   Kristen focuses on finding creative, practical, cost-effective solutions to address her clients’ needs and goals when dealing with these issues.

     

    Wendy McGuire Coats, Moderator

    Wendy McGuire Coats is certified as a specialist in Appellate Law by the California Board of Legal Specialization and is a partner in Fisher Phillips’ San Francisco office, leading the firm’s California Appellate Practice. She represents clients in all aspects of appellate litigation in state and federal appellate courts, particularly in navigating questions of first impression or rapidly evolving labor and employment issues.
    A disciplined writer and appellate strategist, she has briefed dozens of appeals and writs in the United States Supreme Court, the Ninth Circuit and Federal Courts of Appeals, the California Supreme Court, and the California Court of Appeal. 
    Crucial to appellate success, Wendy collaborates with trial counsel and prepares for appellate consequences before, during, and after trial.     Sarah Ellenberg is the Resource Attorney for the Los Angeles County Alternate Public Defender’s Office, providing advocacy to juvenile clients in regard to their educational and disability rights.  Sarah previously defended juveniles in delinquency proceedings, and has also represented adults extensively at the trial and appellate level.  She graduated from New York University School of Law in 2000, where she was a member of the Law Review.  After a year at Gibson, Dunn & Crutcher LLP, Sarah became a public defender in 2001.  She has served as a member of the Los Angeles County Bar Association Criminal Justice Section Executive Committee, as well as the Judicial Nominees Evaluation Commission of the California State Bar.
