    Category: Co-Sponsored Programs, Taxation, Trusts & Estates Trusts and estates are subject to increased tax rates as high as 40.8% on ordinary income as soon as net income exceeds only $12,750 ( in 2019) and 23.8% on qualified dividends and long term capital gains as soon as net income exceeds $12,950 (in 2019). To help practitioners minimize the impact of higher tax rates and avoid many of the traps for the unwary, this program will translate different definitions of income, including fiduciary accounting income, distributable net income and trust taxable income in a clear and concise manner. In addition, this presentation will review the impact of recent tax reform, case law, IRS guidance, and Treasury regulations on the taxation of trusts and estates

    Parties to a trust or estate dispute may resolve their differences through a settlement agreement instead of by proceeding to a final judgment on the merits. If pursuant to that agreement a property right or interest is modified or transferred, a lawyer who fails to consider the tax consequences from the beginning of the dispute risks creating an unanticipated tax exposure for his or her client.


    This program will assist lawyers with identifying the relevant tax exposures; assessing the true after-tax value of a disputed claim; leveraging such knowledge to pursue a settlement strategy beneficial to the client; and reaching a settlement agreement that will not be challenged by the IRS. We focus on the taxes that, in our experience, most likely will appear in a trust or estate dispute: federal and California state income tax; California real property tax; and federal transfer taxes, i.e., the gift tax, estate tax, and generation-skipping transfer tax.

    The Bankruptcy Code provides no specific treatment of a debtor/member’s LLC interest. Case law regarding the effect of a bankruptcy on a debtor/ member’s LLC interest is confusing and contradictory. Judges and counsel for trustees, creditors and debtors struggle with the issues: What happens to an LLC if a member of the LLC files for bankruptcy relief? Is the operating agreement of an LLC an executory contract ? Can a trustee assume the operating agreement? Can the interest of the debtor in an LLC be sold under §363? Join Jay D. Adkisson, renowned speaker and author, for a program that will explore issues that arise when a member/debtor of an LLC files for bankruptcy relief.

    Burk Delventhal, Chief Deputy of the San Francisco City Attorney’s Office, will discuss the history of progressive politics, and the assassination of Harvey Milk and Mayor Moscone and its aftermath and legal impact on the city. Mr. Delventhal was with the City Attorney’s Office at the time of the assassinations, and played a role in the governmental response, and the legal repercussions.

Tired of invoking the Sitwell Doctrine (“What’s your objection counsel? “I don’t know, it just doesn’t sit well.”) The Evidence Survival Tool Kit: It’s More Than Just A State Of Mind is a 2-session course taught over 4 hours by four Superior Court judges designed to provide criminal and civil lawyers with a practical overview of the rules of evidence. Through hypotheticals and simulations, participants will develop a better understanding of the rules and their effective application in trial.


    March 7th: The first 2-hour session focuses on notions of relevance (including the use of out of court statements for non-hearsay purposes,) the requirements of competence and personal knowledge, refreshing recollection, and the introduction of writings and documentary evidence (authentication and the best evidence rule.)


    March 14th: The second session zeroes in on hearsay, including difficult exceptions (state of mind, business records, past recollection recorded and the use of prior inconsistent and consistent statements.)
