    Collaborative Divorce: Good People On Their Worst Behavior

    Understanding the brain science behind conflict, and how it impacts behavior and decision making, can assist the divorce professional to mitigate stress and improve client outcomes – emotional as well as financial. In this presentation we will first briefly explore the anatomy and physiology of the brain functions that control how humans react when feeling threatened. Family law attorneys know these reactions well – confusion, anger, aggression, panic, defensiveness, hostility, paralysis, frustration, fear, and the inability to weigh choices and make rational decisions.

    In many divorces, even if a client “wins” there is ongoing collateral emotional damage to both parties and the children. Attorneys are also impacted by the stress on their clients and the conflict with opposing counsel. We will consider specific techniques and practices to mitigate those impacts, create the conditions for the participants to have respectful discussions, engage in problem solving, compromise, develop creative solutions and look to the future. These techniques serve as the foundation for Collaborative Divorce, Mediation, and Integrative Mediation, however many are also now being utilized in traditional litigation.

    Three specially trained professionals, a psychologist, a divorce financial advisor, and an attorney will address:

    • The brain science triggered by emotions operating during a divorce
    • Basic techniques to mitigate the impact of conflict and threat
    • Strategic use of non-attorney divorce professionals – who, when, why
    • Tools and techniques to assist clients manage the negative emotions brought on by intense family conflict
    • How divorce professionals can avoid contributing to the conflict and manage their own stress
    • How to help clients focus on the future and leave the process with optimism

    Climate change may hurt disadvantaged communities in California the most, as extreme weather impacts and potential rising resource costs threaten to displace some of our most economically vulnerable communities. How can we design and implement policies to reduce greenhouse gas emissions in a way that protects these residents and provides them with a fair share of the benefits? How can practitioners, planners and state and municipal attorneys incorporate these environmental justice concerns into the fight against climate change?

     

    How can attorneys incorporate climate change concerns into their practice? Is there an ethical or professional responsibility to consider and discuss with clients the climate change implications of their decisions?

     

    Presented by Ethan Elkind, an attorney who directs the climate program at the Center for Law, Energy and the Environment (CLEE) at UC Berkeley Law. He also has an appointment at the UCLA Law’s Emmett Institute on Climate Change and the Environment. His areas of focus include land use, transportation, electric vehicles,energy storage, and renewable energy.energy storage, and renewable energy.

     

    As part of this work, he authors policy reports and in-depth studies on environmental topics and is a frequent public speaker at conferences, schools, and other venues. In January 2014, University of California Press published his book “Railtown: The Fight for the Los Angeles Metro Rail System and the Future of the City.”
