    December 4, 2018
    12:00 PM - 1:00 PM (Pacific)

    Description:

Throughout the history of the online commerce, states have been prohibited from collecting taxes from out-of-state merchants under Quill Corp. v North Dakota. That was until South Dakota v Wayfair decided in June in a 5-4 decision which reversed Quill’s physical nexus requirement since it had created “artificial competitive advantages.”
A co-counsel in Wayfair, will explain what this ruling means, the parameters for states seeking to collect sales taxes under this ruling and Congressional legislation to clarify how the process should work.

Trauma-Informed Lawyering: Representing Clients in Sexual Violence and Sexual Harassment Cases

Co-sponsored by the ACBA Labor and Employment Section, the Federal Bar-Northern Ca Chapter, and WLAC

As attorneys, we represent clients who have experienced trauma and who have mental health conditions, yet most of us do not have formal training regarding trauma or mental health issues.

In this MCLE, we will discuss representing clients in sexual violence and sexual harassment cases from a multidisciplinary perspective, applying information about the effects of trauma on the brain and the mental health effects of sexual abuse to the litigation context. We will cover how to build trust with prospective clients, how to assess clients’ resilience, and how to assess our own ability to effectively represent clients in these cases. We will learn how, from a clinical perspective, litigation, administrative grievance processes, and interaction with the criminal justice system affect sexual violence survivors. Finally, we will discuss effective litigation strategy, including how to deal with delays in reporting, how to prepare clients for depositions, and confidential and non-confidential settlements.

Privacy and Surveillance Issues for Immigration Attorneys

Sponsored by the ACBA Immigration Section

Local and federal agencies are expanding their use of surveillance technologies and tactics to target immigrant communities. The federal government is seeking to exploit a range of data sources, including license plate readers, social media, and state databases, to power its enforcement efforts. What is the state of surveillance affecting immigrant communities and their information, and what can attorneys do to protect clients and themselves?
