    Avoiding the Common Pitfalls

     

    Settling employment claims involves more than paying money in exchange for a release. Some claims are not released; payments may be apportioned and paid over time; confidentiality obligations may be imposed; consequences for breach of the agreement may be specified. Things that make settling employment claims challenging will be presented and discussed with the group.

    As solutions to the access to justice gap have been proposed, it has been increasingly clear that there will not be a single solution to the issue. Along with a variety of technology solutions, limited license legal technicians (LLLTs) have emerged as a potential answer to solving access to justice issues. In this episode of the Paralegal Voice, host Carl Morrison talks to Patrick Palace about what LLLTs are and how they provide access to justice in a unique and powerful way. LLLTs provide lower costs, better access to rural areas, and wide-ranging services. There are many situations in which a fully qualified lawyer just isn’t necessary; LLLTs can provide legal advice in these cases.     Kenji Yoshino, Chief Justice Earl Warren Professor of Constitutional Law interviewed Justice Ginsburg regarding diversity, inclusion, and belonging in the legal profession and public life.

    Desc: Speakers John A. Hartog and Margaret M. Hand will discuss planning approaches and the drafting techniques when advising estate planning clients who fear post-death disputes. Attendees to this program will learn about "bribe gifts", uses of powers of appointment to discourage litigation, expense clauses and fee shifting provisions, conditional gift provisions, and no contest clauses.

    John A. Hartog is a California certified specialist in Estate Planning, Trust and Probate Law, and in Taxation Law. He is a Fellow of the American College of Trust and Estate Counsel (ACTEC). He has been selected to the Super Lawyers® Top 100 list by his peers for twelve consecutive years. He has been selected for inclusion in The Best Lawyers in America by his peers for ten consecutive years. Mr. Hartog is the lead consulting editor for the Matthew Bender publication California Trust Litigation; a co-author of California Trust Practice; the lead consulting editor and a co-author for the Matthew Bender multi-volume treatise California Wills & Trusts; he is also a legal consultant to the California Wills and Trusts document assembly program.

    Margaret M. Hand has expertise in crafting practical estate planning solutions for both simple and complicated families. She is a fellow of the American College of Trust and Estate Counsel (ACTEC), a Certified Specialist in Estate Planning, Trust and Probate Law and one of Northern California's Super Lawyers. She lectures at professional education programs throughout California, teaches fiduciary accounting for the CalCPA Education Foundation, and has published a variety of chapters, workbooks and articles on estate planning, probate and trust law; she's the co-author of CEB's Fiduciary Handbook.
