    We’re Moving Office Space!

    We’re excited to announce that as of March 20th we’ll be moving office space! We’re not moving far -just downstairs to the second floor of our building at 1000 Broadway, to Suite 290. It will boast more training space to hold our popular free MCLE programs, and an open floor plan for our staff.

     

    To prep for the move, the ACBA will be closed on Thursday March 15, Friday March 16, and Monday March 19. We will be open on Tuesday March 20th. 

    Please update your address book, and we look forward to sharing our new space with you!

    Supreme Court of California

     

    Chief Justice Tani Cantil-Sakauye is the leader of the state’s third branch of government, the Judicial Branch. In addition to her leadership role on the California Supreme Court, her constitutional duties include serving as chair of the Judicial Council and chair of the Commission on Judicial Appointments. The Chief Justice was nominated to office in July 2010, unanimously confirmed by the Commission on Judicial Appointments in August 2010, and overwhelmingly approved by voters in the November 2010 general election. She was sworn into office on January 3, 2011. Chief Justice Cantil-Sakauye serves as the 28th Chief Justice of California, as well as the first Asian-Filipina American and the second woman to serve as the state’s chief justice. At the time she was nominated, she had served more than 20 years on California trial and appellate courts, including 6 years on the Court of Appeal, Third Appellate District, in Sacramento. Chief Justice Cantil-Sakauye has focused on a vision for improving the public’s access to justice, building partnerships to lead the judicial branch out of the state’s worst fiscal crisis since the Great Depression, and using ongoing self-assessment to improve the branch’s efficiency, effectiveness, transparency, and accountability. She has also taken a leadership role in revitalizing civic learning and engagement in the state.

    Hon. Gary Nadler
    Presiding Judge
    Superior Court of California, Sonoma County

     

    Judge Nadler currently serves as the Presiding Judge of the Sonoma County Superior Court, having previously served in this position from 2009 through 2011. He is presently a member of the California Judicial Council, serving in this capacity since 2014. He is Vice Chair of the Policy Coordination and Liaison Committee and the Judicial Council Technology Committee, and is assigned to the Executive and Planning committee and the Judicial Branch Budget Committee. Previously, he has been a key member of several Judicial Council committees and task forces. Judge Nadler teaches extensively in continuing education for California judges and is a faculty member for the Bernard E. Witkin judicial College. He is a co-author of the California Discovery Handbook and action guides relating to civil discovery for the Continuing Education of the Bar. He has authored numerous articles for the “Bar Journal” of the SCBA; participated as a panelist in over 20 SCBA educational programs; and has served as faculty for over 20 judicial education programs.

    Creative Commons’ legal tools give everyone from individual creators to large companies and institutions a clear, standardized way to grant permission to others to use their creative work in ways copyright would otherwise prohibit. From the reuser’s perspective, the presence of a Creative Commons license answers the question, “what can I do with this” by providing freedom to reuse, subject to clearly defined conditions.
    All Creative Commons licenses ensure that creators retain their copyright and get credit for their work, while permitting others to copy and distribute their work. Although the tools are designed to be as easy to use as possible, there are still some things to learn in order to fully understand how they work. This presentation will give you an overview of the most important things to know. 
    You will learn why Creative Commons was created and how a set of standard open copyright licenses spawned a global movement. You will learn how to apply the CC licenses and how to reuse openly licensed works. And finally, you will come away with a deeper understanding of the legalities behind these ubiquitous legal tools, which are now applied to more than 1 billion works online.

    Sarah Hinchliff Pearson

    Sarah helps to provide legal support to Creative Commons, including assisting in the development of Version 4.0 of the CC license suite. While her primary focus is copyright law, Sarah advises the organization on all facets of CC’s work. Before joining CC, she worked at the Stanford Fair Use Project and as an associate at Fried Frank in New York City. She has a journalism degree from Northwestern University and a J.D. from University of Michigan Law School.

    This course is designed to provide the participants with an overview of civility guidelines, including the California Attorney Guidelines of Civility and Professionalism, and to discuss the issues of civility in the context of pretrial and trial litigation.  Judge Wiley and Judge Darwin will discuss societal and legal changes that have impacted civility and professionalism in the legal profession and also will provide suggestions on how to address these issues and ensure that attorney conduct does not impact the goal of zealous advocacy or prejudice a client’s case.

    Hon. Richard C. Darwin

    Judge Richard C. Darwin was appointed by Governor Brown to the San Francisco Superior Court in December of 2017. Judge Darwin presides in family court.  Prior to his appointment to the bench, Judge Darwin was a Shareholder and Co-Chair of the Buchalter Group’s Litigation Practice Group. As an attorney, Judge Darwin developed a complex civil litigation practice with an emphasis on misappropriation of trade secrets, copyright infringement, and license disputes.  Judge Darwin litigated actions in state and federal court in the biotechnology and software development industries, among many others.  Judge Darwin is a member of the San Francisco Bar Association, the San Francisco Bank Attorneys Association, and the Standing Committee on Trade Secrets of the California State Bar Association. He is a past member of the Executive Committee of the Federal Bar Association, Northern District of California, and is a Master of the Bench in the Edward J. McFetridge Inn of Court. 
    Judge Darwin volunteers at Larkin Street Youth Services, which provides essential services to homeless and at-risk teenagers and young adults in San Francisco. He is also a senior member of The Guardsmen, a non-profit organization that helps send disadvantaged and at-risk Bay Area children to school and summer camp.

     

    Hon. Monica Wiley

    The Honorable Monica F. Wiley was appointed to the San Francisco Superior Court in 2009, and is the second African American female appointed to the San Francisco bench.  Judge Wiley is currently the Supervising Judge of the Unified Family Court.  Judge Wiley also serves as faculty for the California Center for Judicial Education, and teaches Advanced Trial Advocacy at Hastings College of the Law.  
    Judge Wiley served as a Deputy City Attorney in the San Francisco City Attorney's Office for over ten years and was lead trial counsel in 27 jury trials both in state and federal court.  Then, in private practice, Judge Wiley handled catastrophic personal injury and bad faith insurance claims for individual and corporate defendants at the law firm of Carlson, Calladine & Peterson LLP in San Francisco.
    Judge Wiley earned her J.D., Cum Laude, from Howard University School of Law and her bachelor’s degree in Political Economies of Industrial Societies from the University of California at Berkeley.  
    Judge Wiley is a member of the California Judge’s Association, the American Judge’s Association, the Wiley Manuel Law Foundation, Black Women Lawyers of Northern California, and is a lifetime member of the Charles Houston Bar Association.

    In. 2003, the Department of Justice determined that “Title III reaches the web sites of entities that provide goods or services that fall within the 12 categories of ‘public accommodations’ as defined by the statute and regulations.” However, the DoJ has not issued regulations explaining what businesses have to do to comply. This has lead to a rash of litigation around the country. This webinar will discuss the history of ADA website accessibility and what companies need to do to comply.

    Kathy Wahlbin

    Kathy Wahlbin has been very active in the web accessibility community since the 2001 when Section 508 was amended to cover information web technology. As awareness, methods, and requirements have evolved, she has gained considerable experience in accessibility, usability, software applications, and website development. 
    As an invited expert of the W3C WCAG 2.0 Working Group, W3C Mobile Accessibility Task Force and the WCAG 2.0 Evaluation Methodology Task Force, she is knowledgeable in the trends and directions in accessibility, and she contributes to the development of new guidelines, techniques and methodologies. She is passionate about creating a world where online communications and technology are simple and universally accessible to all people regardless of ability.  
    Kathy led the Interactive Accessibility team that won the prestigious Interactive Media Award: “Best in Class” Award. The Interactive Media Awards™ recognize the highest standards of excellence in website design and development and honor individuals and organizations for their outstanding achievement.
    As a recognized accessibility expert, Kathy has been a frequent speaker at conferences educating people on the importance of accessibility and has provided accessibility training for many corporations, government agencies, and universities. 

     

    Heather Antoine, Moderator

    Heather is an Internet and Intellectual Property lawyer and litigator.  Antoine Law Group typically works with e-commerce, SaaS, app, and internet companies. ALG registers trademarks and maintains IP portfolios as well as protects businesses involved in trademark/copyright, social media, domain name, FTC, and rights of publicity litigation. ALG also works with companies to ensure their privacy and cybersecurity practices comply with the law.  ALG performs company audits so startups can pinpoint weaknesses and avoid getting sued.
    Heather regularly speaks about Internet, tech, privacy, and IP law and currently serves as Secretary of the Executive Committee for the IP Section of the California Lawyers Association.
