Intellectual property (IP) disputes can be challenging to settle, especially early in the life of a dispute. Whether due to the perceived need to first adjudicate claim construction (patents), intense factual disagreements as to conduct and intent (trade secrets), customer confusion (trademarks) or other factors, mediation efforts are often delayed, producing unintended consequences, lost opportunities and unrecoverable sunk costs. It need not be this way. The speakers will outline strategies to settle IP cases more efficiently based upon actual early dispute resolution (EDR) initiatives tested and proven in multiple settings.
