     Litigators have a variety of tools for recovering assets from elder abusers. But, often times, the elder’s assets are consumed by the abuser before help is received and a large judgment against the abuser may be uncollectible.  Estate planners have a unique opportunity to prevent the abuse before it happens.  The speakers will explore questioning techniques used in the intake process to uncover and anticipate potential undue influence and drafting strategies to curtail financial elder abuse before it happens.

    If there is one thing that Judge Hernandez can say about listening to lawyers for over 30 years, it is that some lawyers have mastered the art of communicating and others have not. The best communicators, whether they know it or not, are masters of Story Science. Stories are not innocent. They always carry a message.

     

    That is the starting point in the field of Advanced Neural Story Science and the research described in Kendall Haven’s books, “Story Proof: The Science Behind the Startling Power of Story” (2007, Libraries Unlimited) and “Story Smart: Using the Science of Story to Persuade, Influence, Inspire and Teach” (2014, Libraries Unlimited). Story Science shows that human brains/minds are hardwired to place incoming information into Stories. Humans do this automatically and subconsciously into what can best be described as a subconscious Neural Story Net distributed within our brain. It is through this “net” that everyone makes sense of, and creates meaning from, incoming information. Story Science explains this process and shows that Stories have identifiable components and an understandable structure. It is navigating through that structure that captivates the listener.
