The panelists will provide practical tips for preparing cases for success by looking at recent adjudication trends and common requests for evidence (RFEs) from USCIS. Other topics include the impact of unlawful presence memos on H-1B petitions, special issues that arise for start-ups and small employers, and selecting the occupational classification code.

    In Helsinn Healthcare S.A. v. Teva Pharmaceuticals USA, Inc., the U.S. Supreme Court affirmed the Federal Circuit’s interpretation of the “on sale bar” — holding that “Congress did not alter the meaning of ‘on sale’ when it enacted the AIA.” In so doing, the Supreme Court answered affirmatively that a secret sale of an invention, or a sale of a technology under terms that require the invention to remain confidential, is barred under 35 U.S.C. § 102(a)(1), thereby preventing the invention from being patented. In this webinar, our panelists will weigh in on the impact of this decision and offer practical pointers to stakeholders and practitioners when dealing with secret, on-sale offers, activities, or commercialization.

    The Supreme Court’s recent decision in Ohio v. American Express, in which the Court held that AmEx’s anti-steering provisions do not violate the antitrust laws, was closely watched and elicited strong reactions on both sides. While some celebrated the decision’s recognition of two-sided “transaction platforms” as a relevant market with distinct characteristics and concerns, others criticized it as an unwarranted departure from traditional rule of reason analysis. This panel discussion will explore the treatment of two-sided markets in antitrust law, with an emphasis on how the AmEx decision has been interpreted by courts and invoked by litigants thus far and how it is likely to shape legal theories and analysis in antitrust cases going forward.

    The Family Law Executive Committee of the California Lawyers Association (FLEXCOM) is pleased to announce it will be hosting the Third Annual San Luis Obispo County Minor’s Counsel Training Symposium, in Pismo Beach, California on February 16 and 17, 2019. The program will provide a total of 12 hours of total MCLE credit, including 12 hours of Family Law Legal Specialization credit. The symposium will satisfy the annual 8 hours training requirement of Rule 5.242 of the California Rules of Court. Those attorneys needing to satisfy the 12 hours initial training requirement will be able to attend a morning session on February 16 to obtain the additional 4 hours.
