    In this CLE program, SEC veterans Jina Choi and Marc Fagel provide an insider's view of where the SEC has been and where it's going. Ms. Choi is a former federal prosecutor who went on to a lengthy career in the SEC, including serving as the Regional Director of the SEC's San Francisco Regional Office from 2013-2018. Mr. Fagel spent 15 years at the SEC, including serving as Regional Director of the SEC's San Francisco Regional Office from 2008-2013. The Moderator, Timothy Crudo, was an Assistant United States Attorney in San Francisco, where he served as Chief of the Securities Fraud Section.

    When you need a nondisclosure or confidentiality agreement (NDA) as part of potential new business deals, M&A discussions, or in relation to employee hires, do you simply plug in party names into an old template, execute, and move on? If so, you’re not alone. But we can all do better.


    This webinar will cover the use of NDAs in business contracts and M&A transactions, in the employment context, and in dealings with public agencies as opposed to private parties. We will discuss when it is appropriate to use a mutual NDA as opposed to a one-sided NDA.
