    The California Supreme Court today announced the reappointment of two current members and the appointment of a new member to fill a vacancy on the Supreme Court Committee on Judicial Ethics Opinions (CJEO), an independent committee that helps inform the judiciary and the public on judicial ethics topics.


    Judge Erica R. Yew of the Santa Clara Superior Court was appointed to fill a vacancy on the committee and will serve a four-year term starting May 1.


    Justice Marla J. Miller of the First District Court of Appeal and Judge Curtis E.A. Karnow of the San Francisco Superior Court were both reappointed to serve four-year terms, which began Jan. 1.

    The California Supreme Court has appointed Los Angeles County Judge Lisa B. Lench to the Commission on Judicial Performance, an independent state agency responsible for investigating complaints of judicial misconduct or incapacity and disciplining judges.

    Catherine Fisk, a UC Berkeley labor law professor, suggested that the appeals court decision breaks new ground “because it applies the California rule for determining who is an employee to the abuse of franchising.... Companies like Jan-Pro invent a franchise model that allows them to have a huge low-wage work force while disclaiming any responsibility for the working conditions.

    The American Bankruptcy Institute and legal research company Fastcase today said that they are partnering to make ABI’s catalog of bankruptcy publications available on Fastcase.


    Fastcase subscribers will be able to purchase access to 33 ABI titles and then have access to them through their accounts on the Fastcase platform.

    “I formed the opinion that this is really our responsibility,” said George Gascon, San Francisco’s district attorney.


    Though almost 10,000 people in the city were predicted to be eligible for expungement, just 23 had come forward.


    So in January 2018, Mr Gascon pledged to proactively review past marijuana cases - but there was a snag.


    “When we started to do this by hand, we recognised very rapidly that this was going to take a long time.”


    He enlisted Code For America, a non-profit organisation that works on creating Silicon Valley-esque solutions to problems within the many antiquated systems powering the US government.


    The group had made Clear My Record, a tool that can analyse text in court files, using character recognition to decipher scanned documents.


    It discards any record involving a violent crime, as such records do not qualify. For those that remain, the tool automatically fills out the necessary paperwork. In other words, the algorithm replaced the process being done manually at the expungement clinics.


    Working with San Francisco’s raw data, Code For America was able to identify 8,132 eligible criminal records in a matter of minutes - in addition to the 1,230 found manually already. They dated as far back as 1975, the year in which the city started digitising its files.


    And so it was, on 3 April, that San Francisco judge Samuel K Feng signed them all off - reopening life opportunities for thousands of people.

    About the speaker:

    James J. Brosnahan is Senior of Counsel at Morrison & Foerster LLP. He regularly undertook complex cases that are about to go to trial. He has tried, to conclusion, 150 civil and criminal cases. His cases have ranged from anti-trust to wire fraud and from patent litigation to white collar crime and murder. A “lion of the trial bar,” Mr. Brosnahan is one of the most respected and recognized trial lawyers in the United States. He represented the former President of the Board of Education in San Francisco in a case charging murder for hire.  Mr. Brosnahan has been named among the top 30 trial lawyers in the United States, according to the Legal 500 US 2013. Mr. Brosnahan has more than 55 years of expertise in both civil and criminal trial work. Mr. Brosnahan was the Deputy Special Counsel assigned to prosecute Casper Weinberger, the former Secretary of Defense.


    In 1996, he was inducted into the State Bar of California’s “Trial Lawyers Hall of Fame” and was awarded the Samuel E. Gates Award by the American College of Trial Lawyers in 2000. In 2012, he was recognized as a Lifetime Achiever by The American Lawyer for outstanding professional success and a devotion to public service. Other professional recognitions include American Board of Trial Advocates’ Donald E. Bailey Civility and Professionalism Award (2018), Justice Wiley W. Manuel Pro Bono Award (2018), White-Collar Crime/Government Investigations (2005-2012), and the San Francisco Lawyers’ Club honored Mr. Brosnahan with its inaugural “Legend of the Law” award. He has been recommended as a leading lawyer by Chambers USA every year since its launch. He is also ranked in the Best Lawyers in America 2014 (for the past 29 years).


    Mr. Brosnahan is a past president of the Bar Association of San Francisco, whose Volunteer Legal Service Program he founded. He also serves as Master Advocate on the faculty of the National Institute for Trial Advocacy.


    He presently teaches a Persuasion course at Berkeley Law School.
