MCLE - Current Developments in Climate Change Litigation

In cases being litigated in California and elsewhere across the country, youth and municipal plaintiffs assert common law theories and seek tort remedies for alleged climate change-related harms. The suits present important legal questions left open by previous climate change litigation, including AEP v. Connecticut, 564 U.S. 410 (2011) and Native Village of Kivalina v. ExxonMobil Corp., 696 F.3d 849 (9th Cir. 2012).

Program Panelists Will Discuss
• The status of the common law of climate change after AEP and Kivalina
• The availability of constitutional and public trust theories to redress harms related to climate change
• The ability of the courts to fashion appropriate remedies in climate change suits
• The policy implications of adjudicating climate change-related tort claims under state law
