Cy Pres - The Changing Landscape of Class Action Residuals & How to Leverage the Funds to Increase Access to Justice
If you ever handle class actions, you should be familiar with the cy pres doctrine. California Code of Civil Procedure ยง 384 governs the acceptable use of residual monies from class action cases (cy pres awards).
During this session you will learn the ins & outs of cy pres and how to use it (including tools, such as sample settlement agreement language and sample orders). The cy pres doctrine has also been the subject of recent scrutiny - you will learn about recent state law changes and about the cy pres issue currently before the United States Supreme Court in Frank v. Gaos. Finally, you will learn about statewide access to justice issues, the nonprofit organizations working to address them, and how you can use cy pres to help.
