Ethically Protecting You & Your Client in Matters Involving Criminal Conduct, Discrimination, & Harassment

 

Do you know what to do or where to turn if your client is a victim of sexual assault or domestic violence?  Are you equipped to deal with financial fraud?  Are you able to spot workplace discrimination, harassment, or retaliation and know where to direct your client?  Has your bias impacted effective representation and advocacy?  Issues involving criminal, employment, trauma survivors, and other related legal topics often arise in estate planning. This seminar will discuss these cross-over matters, utilizing real-world scenarios.

 

SPEAKER: Terry R. Leoni is the Owner and Principal of Leoni Law.  Ms. Leoni began her legal career tenaciously fighting for crime victims as a Deputy District Attorney in Contra Costa County.  In 2009, Ms. Leoni joined the firm of Rains Lucia Stern, where she continued to fight for crime victims as well as zealously defend public safety and other public employees in labor, employment, and administrative matters, and successfully handled some of the highest profile administrative, criminal, employment, and public safety matters in California.  Wanting to further expand her practice, Ms. Leoni began Leoni Law in January of 2017, where she continues to specialize in representing public employees and unions.  Ms. Leoni has been recognized as a Rising Star in Administrative Law since 2013, noted as a Top Women Attorney in Northern California since 2013, and Leoni Law has a 10.0 Superb Avvo rating.

Attorney-Client Privilege and Attorney Work Product from a Trusts and Estates Perspective

 

An overview and analysis of what trusts and estates practitioners need to know about privileges including, but not limited to: Can you withhold attorney work product documents from your client in estate planning?  How do you differentiate administration and litigation attorney-client privilege under Moeller v Superior Court and related case law?  Can you assert the attorney-client privilege regarding work performed for a settlor notwithstanding Evidence Code 957?  What are some of the privilege considerations arising from Doolittle v Exchange Bank?

 

SPEAKER: John A. Hartog focuses his practice on trust and estate law: planning, administration, dispute resolution and litigation. Extensively published, he has co-authored three practice guides essential to professionals in the field: California Wills & Trusts, California Trust Practice and California Trust Litigation. Mr. Hartog is certified by the California Board of Legal Specialization as a specialist in taxation law and in estate planning, trust and probate law. He is past chair of the executive committee of The State Bar of California’s Trust and Estates Section, as well as past chair of the Estate Planning, Trust and Probate Law Advisory Commission to the California Board of Legal Specialization. Mr. Hartog is also a legal consultant to the California Wills and Trusts document assembly program. He is a shareholder of Hartog, Baer & Hand, APC in Orinda, California.

 

SPEAKER: Andrew R. Verriere focuses his practice on trust and estate litigation, including will and trust disputes, contested conservatorships, and related civil actions.  He also serves as a court-appointed discovery referee.  He has tried cases in state and federal court, including a 2016 jury trial in Santa Clara County resulting in a jury verdict of over $3 billion for his client.  He has authored articles and presented continuing legal education courses on issues related to trust litigation and financial elder abuse.  He is a senior associate at Hartog, Baer & Hand, APC in Orinda, California.
