Passing On: Addressing Issues of Fairness in Estate Planning
Estate planning attorneys often are asked by their clients whether their intended estate plan is fair. But what is “fair” and from whose perspective is fairness to be judged? Presented by a sociologist and an attorney/mediator, this session addresses a series of themes relating to questions of fairness and social justice as they affect the attorney’s role in guiding clients through the decision-making process.
- Are there competing principles of fairness? How do they apply to particular estate planning situations?
- How can professionals assist clients in choosing their beneficiaries and personal representatives and distributing their property freely and fairly?
- What are the best approaches to including other family members in the decision-making process in order to minimize disputes and litigation?

Speakers:
Frederick Hertz is an attorney-mediator based in Oakland. His practice focuses on resolving financial and property disputes surrounding inheritance, separation and divorce within traditional and nontraditional families.
Ruth Dixon-Mueller, Ph.D., is the author of Pa$$ing On: What’s Fair in Family Inheritance? Formerly professor of sociology at the University of California at Davis, she has published widely on topics relating to social policies and women’s rights.
