Indecent Contact: Ethical Challenges with Contacts with Putative Class Members

This program offers 1 hour participatory MCLE credit in Legal Ethics. You must register in advance to participate.

 

Class litigation is a minefield of potential ethical problems for attorneys seeking to contact potential class members because of rules against contacts with represented parties.  This program will cover:

  • What contacts are covered by California Rule of Professional Conduct 2-100
  • Distinguishing when a subordinate is represented by corporate counsel
  • Under what circumstances may an attorney contact a putative class member
  • How the stage of the litigation and the timing of class certification may (or may not) affect the ability of counsel to contact a class member
