Ethical and Practical Tips for Ending a
Client Relationship or Law Practice

 

This panel will address the many thorny ethical issues that arise when a lawyer ends his or her relationship with a client, including how to ethically withdraw from a representation and what steps a lawyer must take to protect both clients and him or herself when departing a law firm. It also will explore issues relating to the winding down of a practice or law firm, and how a lawyer can assist a colleague during or after an unexpected illness or death.

Carla Boyd Terre is a Certified Family Law Specialist (CFLS) by the State Bar Board of Legal Specialization. She is a family law attorney and mediator at Terre Family Law, a small family law firm in Santa Rosa. Ms. Boyd Terre worked briefly for a civil litigation firm in San Francisco and then started her family law practice as an Associate for Bruce H. Schwartz, CFLS, in Santa Rosa in 2004. After Mr. Schwartz passed away in 2007, Ms. Boyd Terre assisted Mr. Schwartz’s family with closing his law practice and started her own law firm in April 2007. Ms. Boyd Terre is also the Past President of SCBA (2015) and the past Chair Person of the SCBA Family Law Steering Committee (2009).

Mr. Garner represents clients in a wide array of complex business litigation matters with a particular focus on professional liability disputes and ethics counseling. He has represented large, mid-size, and small law firms, along with individual lawyers, in pre-litigation and litigation disputes concerning claims of legal malpractice, ethical violations, and securities fraud arising from their litigation, transactional, and IP practices. He also consults with clients on legal ethics issues, and has served as an expert witness on ethics and standard of care issues. Mr. Garner also represents public and non-public companies in a variety of matters, including contract disputes, intellectual property disputes, securities litigation, and hospital and healthcare law matters.

 

Mr. Garner is active in Bar and community organizations. He currently serves as an officer (Secretary) of the Orange County Bar Association and as Co-Chair of the OCBA Professionalism and Ethics Committee and as Co-Chair of the OCBA Civility Task Force. From 2010-2016, he was a member of the California State Bar’s Committee on Professional Responsibility and Conduct, serving as Chair of that Committee in 2014-15. He is the Immediate Past President of the Orange County Chapter of the Association of Business Trial Lawyers and as a current member of the Board of Directors of the Junior Statesmen Foundation.

 

Mr. Garner writes and speaks frequently on lawyer ethics and liability matters and earned a JD cum laude from Harvard Law School in 1991 and a B.A with distinction from Stanford University in 1988.

Ms. Buchanan is a Certified Specialist in Legal Malpractice Law as certified by the State Bar of California Board of Legal Specialization and Shareholder in Hoge • Fenton’s Silicon Valley office, where she focuses her practice on business litigation. In addition to her legal malpractice work, Ms. Buchanan represents clients in complex business disputes, including contract, fraud, misappropriation of trade secrets, and unfair competition claims. She has significant trial experience and is a sought-after speaker on attorney ethics.

 

Ms. Buchanan was named a “Northern California Super Lawyer” for 2017, 2016, 2015, 2014 and 2013, as chosen by her peers and through the independent research of Law & Politics and San Francisco Magazine. She was named a Northern California “Rising Star” in 2012.

 

Ms. Buchanan received her J.D. from Chicago-Kent College of Law (Illinois Institute of Technology), with honors, and her B.A. in Criminology, Law & Society from the University of California, Irvine.
