Making a silk purse from a sow’s ear. Ouch!

    Discussion will include ~

    • Trading the claim for certainty, or is that so?  Maximizing the recovery or leaving money on the table?  Financial statements or an URLA?
    • Is the pen mightier than the sword?  Or the Settlement Agreement not worth the paper?  Did you lose the keys to the courthouse by dismissal?
    • The secret sauce of collateral and guarantees, lest the settlement, if unsecured, expires.
    • Mutual releases set free the scavengers, insiders, and thieves who loot the company.
    • The 12 ingredients of any settlement.  Checklists are your buddies.
    • Expect a default.  Expect bankruptcy.  Expect a sale.  Expect another lawsuit.  Expect a disaster.
    • Confidentiality?  Why?  Why not?  Keeping secrets is in whose best interests?
    • Salvage Settlements, High Interest Settlements, Two for the price of one and other stories.
    • CCP Section 664.6. Sign on the dotted line. Speak up in court or everything ends on the floor.
    • Necessity of Acceleration and notice of default.  Details are king.

About the Speaker: David J. Cook

In this upcoming webcast, get three different perspective on how an in-house e-discovery director, a judge, and an e-discovery manager interpret case law and what 2018 cases made them take notice and potentially modify their processes.
