    IP disputes are challenging to settle early in the life of a dispute. Accordingly, mediation efforts are often delayed, frequently triggering unintended consequences, lost opportunities and unrecoverable sunk costs. It need not be this way. The speakers will outline strategies to resolve IP disputes more efficiently through tested early dispute resolution (EDR) initiatives and examples of earlier diagnosis and resolution of all forms of IP disputes. While one size does not fit all, patterns, similarities and opportunities will emerge, prompting practical ideas applicable to most IP disputes.

    In Epic Systems, the Supreme Court approved employee waivers of workplace class action claims in favor of individual arbitration proceedings, and, in so doing, rejected federal statutory protection of such claims. Will Armendariz survive? What impact will Epic Systems have on employment litigation practice in California? This panel discussion looks at both plaintiff and defense perspectives on the broader subject of mandatory arbitration as a condition of employment and in litigating cases before arbitrators after Epic.
