    This panel will address the many thorny ethical issues that arise when a lawyer ends his or her relationship with a client, including how to ethically withdraw from a representation and what steps a lawyer must take to protect both clients and him or herself when departing a law firm. It also will explore issues relating to the winding down of a practice or law firm, and how a lawyer can assist a colleague during or after an unexpected illness or death.

    Does the adversarial system necessarily require incivility on the part of the participants? Does the fact that each party enters a matter with the intent to triumph over the other side require disrespect of one’s opponent? Winston Churchill did not think so. After the Japanese bombing of Singapore and Hong Kong in 1941, Winston Churchill dispatched a letter to the Japanese Ambassador announcing that a state of war existed between England and Japan. After noting the acts of aggression, Churchill’s letter ended with these words: “I have the honour to be, with high consideration, Sir, Your obedient servant, Winston S. Churchill.” Churchill commented in his memoirs, “Some people did not like this ceremonial style. But after all when you have to kill a man it costs nothing to be polite.” Clearly, the ability to maintain civility can be accomplished, even under the most adversarial situations.

    Ms. Carrillo is an experienced trial lawyer who has handled every kind of criminal case. Driving under the influence, domestic violence, gang violence, and murder are just a few areas she has specialized in. Starting out in the Riverside County District Attorney’s Office, Ms. Carrillo handled a high volume caseload and quickly established herself as an aggressive trial lawyer. She was awarded misdemeanor and felony trial prosecutor of the year in 2001 and 2004 respectively.

     

    In 2008, Ms. Carrillo moved to Sonoma County where she gained additional experience in handling murder cases, domestic violence, and juvenile matters. In 2010, she was awarded trial advocate of the year. Over her career so far, she has successfully handled a large volume of complex and high profile criminal matters.

     

    In 2015, she started her own firm, handling criminal defense and family law matters, where she continued to litigate in the courtroom, handling hearings and trials. She joined PJAMM in June 2017 where she continues to litigate criminal defense and family law matters.

    On January 22, 2018, the Santa Clara County Bar Association's High Technology Section will host its annual Intellectual Property Year in Review.  Come and hear an update from the Director of the Silicon Valley USPTO, John Cabeca, on the activities of our regional USPTO office, located at City Hall in San Jose.  The seminar will feature speakers on three areas of IP law: patents, copyrights, and trademarks.  Speakers will survey key intellectual property cases and other developments in intellectual property law during 2017, discuss their impacts, and share insights for practitioners.  The event will begin at 12 PM at the San Jose office of Hopkins & Carley.  Lunch will be provided by the firm.

    In order to avoid impasse in high conflict cases it is essential that the parties feel that we understand them and care about them. And yet the openness required to make empathic connection leaves us vulnerable to the toxicity that is often present in such cases. In this talk Steve will explore ways in which mediators can increase their capacity to tolerate high levels of emotional stress while still remaining open and present, as well as proven interventions that can be made from a stance of undefendedness. The result is better outcomes for clients and healthier experiences for mediators.

    Stephen H. Sulmeyer, J.D., Ph.D. is a lawyer, psychologist, mediator, and collaborative law practitioner. His psychotherapy practice is based in Marin County, California. He offers alternative dispute resolution services in Marin County, San Francisco, Sonoma County, the East Bay, and throughout the Greater Bay Area. Steve’s unique blend of law and psychology allows him to identify and work effectively with, rather than shy away from, the underlying psychological obstacles that are often the real barriers to the resolution of conflicts. Steve’s conflict resolution work covers a wide range of subject areas including family and divorce, business/commercial, intellectual property, employment, probate, elder, trusts, estate planning, discrimination, partnerships, insurance, and community matters. He is also a trainer in psychotherapy, mediation, and collaborative divorce.
