Cybercrime is one of greatest threats facing our country.  Theft of trade secrets or other intellectual property or confidential information have an estimated loss of $250 billion a year.  Knowledge assets are confidential information critical to a company’s core business and must be protected yet, less than 48% of a company’s board is informed about protecting critical confidential data.  A company’s data security measures and responses must be reasonable and appropriate.  This requires a continuous process of assessing and addressing risks.

This collaborative justice court program debuted on Friday August 11th in Department 31. Research has shown that veterans who are experiencing post-traumatic stress disorders, military sexual trauma, traumatic brain injuries, substance abuse or other mental health disorders related to military service are uniquely positioned to benefit from treatment targeted to the root cause of criminal behavior. The goal of the Veterans Treatment Court is to resolve criminal cases through treatment and support tailored to the veteran's particular needs.

Come learn how your clients might benefit from this uniquely tailored approach.

Challenges also arise from: the range of interests that need to be considered, including some that might not be represented at the mediation, trying to clarify what the real issues and sources of dispute, meeting (or ignoring) Probate Code and Tax Code structures, ethical dilemmas posed by attorney-client and multi-party tensions. Richard J. Collier has a litigation and ADR practice with Cooper, White & Cooper LLP. He trained as a mediator in 1993 and has mediated over 400 disputes covering a wide range of subjects, number of parties, and dollar
amounts. He is a Past President of The Mediation Society (2009) and, with Dana Curtis, chaired the BASF Mediation Committee for many years. He serves as an arbitrator and mediator for the American Arbitration Association and as a mediator and neutral evaluator for the Northern District of California United States District Court’s ADR Program. Before practicing law, Mr. Collier taught in the English Department at UC Berkeley, where he received the University’s Distinguished Teaching Award.

Ethical Considerations for Family Law Attorneys Consulting With Mental Health Professionals   More and more, family law attorneys are using mental health professionals to consult with them and their clients, particularly in cases involving child custody and visitation. Such consultations may take place prior to or during litigation and the processes of mediation and evaluation.   There are a variety of roles mental health professionals can assume in the family law system, many of which are specified and circumscribed by California law. The role of the mental health consultant, however, is not defined by law. Therefore, the rules that apply to such consultants are not clear. Some family law experts, including bench officers, have expressed concerns about the use of such consultants and the possible detrimental effects such consultation could have on evaluative and judicial processes, making the use of such consultants somewhat controversial.   This presentation will examine the various roles mental health professionals play in the family law system, the various roles mental health consultants can play, and ethical issues raised when mental health professionals act as consultants for family law attorneys and litigants.    Light lunch provided. Stuart Lord, MFT

 

Stuart Lord has been licensed as a Marriage and Family Therapist since 1980. For nearly 25 years before retiring in 2012 from Family Court Services of the Contra Costa County Superior Court, he worked as a child custody mediator, evaluator, and recommending counselor. During two leaves from the court, he lived in West Africa, where he served as a crisis intervention therapist and trainer with the US Peace Corps, a resource specialist and consultant at the International School of Niamey (Niger).

In his current private practice in Walnut Creek, he offers psychotherapy to adults, couples, and families, child custody mediation, co-parenting counseling, collaborative divorce coaching, and consultation to family law attorneys and litigants involved in child custody suits, recommending mediations, and evaluations.
