    John Kopilow received an ABA approved paralegal certificate in 1993 from Skyline College, and has owned Legal Document Professionals & Notary Service since 2011. His journey to becoming a committed Legal Document Assistant began with his experiences as an estate executor, and in a small claims lawsuit. Mr. Kopilow has been active in the California Association of Legal Document Assistants (CALDA) putting together continuing legal education seminars for the Legal Document Assistant.     Kerry Spence is a certified paralegal and a registered legal document assistant (LDA). In 1977 she received from the University of San Diego one of the first American Bar Association approved paralegal certificates issued in the State of California. She is the daughter of one of America’s icon trial lawyers, Gerry Spence (see gerryspence.com). Ms. Spence has been recognized as a pioneer and leader in the paralegal profession. She is founder of FLPP of California (FreeLance and Public Paralegals of California), an organization for self-employed paralegals and CELA of California (Cost Effective Legal Access), an advocacy group whose focus is legal access for the self-represented consumer. Ms. Spence is on the advisory boards of: Skyline College Paralegal Program; SFPA (San Francisco Paralegal Association); and CALDA (California Association of Legal Document Assistants). Since 1982, she has been in private practice providing services to the public and to attorneys. Ms. Spence lectures state wide on affordable legal access issues and concerns.

    Estate planning attorneys often are asked by their clients whether their intended estate plan is fair.  But what is “fair” and from whose perspective is fairness to be judged? Presented by a sociologist and an attorney/mediator, this session addresses a series of themes relating to questions of fairness and social justice as they affect the attorney’s role in guiding clients through the decision-making process.

    • Are there competing principles of fairness? How do they apply to particular estate planning situations? 
    • How can professionals assist clients in choosing their beneficiaries and personal representatives and distributing their property freely and fairly? 
    • What are the best approaches to including other family members in the decision-making process in order to minimize disputes and litigation?

    Professor Bernhardt is a leading authority on real property law in California. He has authored numerous attorney and student books and is editor of CEB’s California Real Property Law Reporter. Professor Bernhardt is past chair of the Legal Education Committee of the American Bar Association’s Real Property, Probate and Trust Section and former member of the Executive Committee of the Real Property Section of the California State Bar. He is a member of the American Law Institute, the American College of Real Estate Lawyers, and the American College of Mortgage Attorneys.

    Professor Tim Iglesias, an expert in housing and property law, has served on the USF law faculty since 2001. He is a frequent speaker and media commentator on housing issues. In 2015, he was appointed by Gov. Brown to the California Fair Employment and Housing Council, which drafts regulations to protect Californians from discrimination and and hate violence.

    Gun Violence Restraining Orders

     

     

    Preventing Gun Tragedies: Understanding California's New Gun Violence Restraining Order Law

    In response to the Isla Vista massacre on May 23, 2014, California enacted the Gun Violence Restraining Order (GVRO), the first law of its kind that allows family and household members to petition a court for an order temporarily removing a dangerous person's access to guns. GVROs have been used to disarm suicidal individuals, domestic abusers, and people on the terror watchlist.

     

    This program will help attendees understand the key aspects of this groundbreaking law that went into effect on January 1, 2016, and how to identify the circumstances under which it should be utilized to help prevent suicides and other gun violence.

    Allison Anderman became the managing attorney at Giffords Law Center in April 2017, after joining the organization as a staff attorney in January 2014. One of her primary focuses is partnering with cities and counties around the country to improve local gun laws.

    A leading expert on firearms policy and legislation, Allison frequently speaks at conferences and events around the country and has analyzed and debated gun laws on CNN, HuffPost Live, and other news programs. Allison’s radio appearances include national NPR, KQED in San Francisco, KCRW in Los Angeles, and many other regional stations. She has been quoted extensively in the press, including by the New York Times, the Los Angeles Times, Newsweek, the Guardian, and many others.

    Prior to joining Giffords Law Center, Allison defended low-income individuals sued by debt collectors at two San Francisco Bay Area nonprofit organizations. She also practiced employment law at a Marin County firm.     Please join EBTEL and the ACBA on February 2nd for an all-day mediation training. Join Jim Melamed, long-time mediator and founder and CEO of Mediate.com, for consideration of how we can grow and elevate probate and elder issue mediation. In addition to practice and policy considerations, Jim will review strategic approaches and his favorite techniques for assisting participants to agree.


    The Alameda County Probate Court will be updating its list of probate mediators for the first time in many years. The Alameda County Probate Court typically updates its list of probate mediators every several years, so we encourage you to take advantage of this opportunity.
